SMB Rules One Community Proposal Correctly Follows Municipal Act

On November 18, 2021, the Saskatchewan Municipal Board (SMB) held a preliminary hearing to address the RM of Edenwold’s objection to the Town of White City submitting its Boundary Alteration Application directly to the SMB as opposed to the Minister of Government Relations.

The hearing ran for approximately 2.5 hours and included legal arguments from both the Town and RM representatives.

On December 14, 2021, the SMB issued its decision in which it ruled that the Town had followed the correct procedure by submitting its Application to the SMB and that the SMB has the jurisdiction to decide the Town’s Application.

The next step is to proceed to a hearing on the merits of the Town’s Application.  It is anticipated that the SMB will provide direction as to the scheduling of the hearing on the merits in the first half of 2022.

The Town will continue to work with its legal team to coordinate next steps and prepare for the SMB hearing.
